Drugs and Narcotics

Boston Municipal Court - West Roxbury Division

Police found a large amount of narcotics hidden in the client's car and arrested him. The client was charged with numerous narcotics offenses and faced significant jail time, including minimum mandatory jail sentences. Attorney Lazar filed a motion to suppress the evidence, arguing that the police violated the client's constitutional rights when they searched his car. After a hearing, the judge agreed and allowed Attorney Lazar's motion to suppress all of the evidence seized in the car. As a result, all charges were dismissed.

Boston Municipal Court - Roxbury Division

After pulling the client over for traffic violations, police claimed that they smelled unburnt marijuana coming from the car window. Police ordered the client and passenger out of the car and conducted a search. They found large amounts of marijuana and a large amount of cash. Attorney Lazar filed a motion to suppress, arguing that police could not order the occupants out of the car based on the smell of unburnt marijuana. After a hearing, the court agreed and allowed Attorney Lazar's motion. The case was dismissed and the client's money was returned.

OUI/DUI

Boston Municipal Court - Roxbury Division

The client was arrested for operating under the influence of prescription narcotics. At trial, Attorney Lazar presented key evidence that the client had an allergic reaction to newly prescribed medication. As a result, the client was found not guilty.


Result - Not Guilty on All Charges

Boston Municipal Court - Central Division

Police arrested the client for operating a motor vehicle under the influence of liquor after being involved in a serious accident. The client failed all of the field sobriety tests and provided a breathalyzer test that was well over the legal limit. Attorney Lazar argued for and secured a continuance of the client's case for one year. If the client successfully completes probation, the case will be dismissed.


Result - Case to Be Dismissed After 1 Year After Probation

Driving Offenses

Dudley District Court

A state trooper pulled over the client on the Mass Pike for speeding. A check of the client's driver's license revealed it was suspended. The client thought his license was valid, but instead he was summonsed to court for operating a motor vehicle with a suspended license and speeding. Attorney Lazar successfully argued for the case to be dismissed prior to arraignment. As a result, the court ordered the payment of a small fine instead - keeping all charges off of the client's record.


Result - All Charges Dismissed Prior to Arraignment

Lynn District Court

The client was charged with reckless operation of a motor vehicle after police observed him driving erratically on a major road during rush hour. At a hearing, Attorney Lazar highlighted the client's exemplary work record, lack of a criminal history and ties to the community and, as such, secured a dismissal of all charges after the client paid a small fine and stayed out of trouble for three months.


Result - All Charges Dismissed After Three Months

Lawrence District Court

The client was arrested for drag racing at over three times the speed limit. The prosecutor was seeking time in jail based upon the client's actions and his record. Attorney Lazar successfully argued for probation instead, and the client avoided all jail time.


Result - No Jail Time Only Probation

Firearms

Boston Municipal Court - Brighton Division

The client, a graduate student at a local university, was charged with unlawful possession of a firearm. The client legally owned the firearm in another state but did not have the firearm registered in Massachusetts. Attorney Lazar negotiated with the prosecutor and the judge to drop all of the charges if the client stayed out of trouble for two months.


Result - Pretrial Probation - Case Dismissed After Two Months

Boston Municipal Court - Central Division

The client was passenger in a motor vehicle when police stopped the driver for traffic violations. The police searched the car and found a firearm in the trunk. Prosecutors charged the client with multiple possession of firearms offenses, one of which carried a minimum mandatory jail sentence. After pre-trial negotiation, Attorney Lazar convinced the prosecutor to drop all of the charges against the client for lack of evidence.


Result - All Charges Dismissed

Assault and Battery

Boston Municipal Court - Roxbury Division

Police arrested the client after a physical altercation with his girlfriend. After a thorough investigation, Attorney Lazar discovered that the alleged victim had attacked the client with a knife. During trial, the prosecutor presented evidence that the client had bragged about his alleged crime on social media the day after the incident. Attorney Lazar successfully argued that his client acted in self-defense, and the jury returned a not guilty verdict.


Result - Client Found Not Guilty On All Charges

Boston Municipal Court - Roxbury Division

The client was involved in a physical altercation with his wife. The police arrested him for assault and battery. Attorney Lazar investigated the incident and argued that the charges be dismissed for lack of evidence. After hearing the matter, the judge agreed and dismissed all charges.

Theft

Boston Municipal Court - Roxbury Division

The client, an undergraduate student at a local university, was charged with a number of crimes, including theft of a motor vehicle. At the arraignment, Attorney Lazar successfully argued that because of the client's age, lack of criminal record, and a promising future after college, his client should be allowed to enroll in a pretrial diversion program. As a result, all charges were kept off the client's record.


Result - Pretrial Diversion - Case Dismissed After Three Months

Pre-Arrest Investigation

A local police detective contacted the client on Christmas Eve. The detective told her that he possessed video evidence of her allegedly stealing an Xbox from a local Best Buy. The client immediately retained Attorney Lazar. Through negotiations, Attorney Lazar was able to convince the detective not to charge his client with any crimes.
